  "Content" refers to any text, images, or other material provided by Users, Hosts, or Staykay on the Platform.

2. Use of the Platform

  Eligibility: You must be at least 18 years old to use our Platform.

  Account Registration: Users must create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.

  Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

3. Host Responsibilities

  Listings: Hosts are responsible for ensuring their listings are accurate and up-to-date. This includes information about availability, pricing, and amenities.

  Property Maintenance: Hosts are responsible for maintaining their properties in a safe and clean condition.
• •
  Compliance: Hosts must comply with all local laws and regulations regarding short-term rentals. For more information, you may visit this resource.

  Insurance: Hosts are responsible for obtaining appropriate insurance for their accommodations.
• •
  Platform Exclusivity: Hosts are prohibited from inviting, tolerating, or accepting platform guests to make transactions outside of the Staykay platform. Our system can detect such behavior, and hosts found violating this will be subjected to banning from the platform.

4. Guest Responsibilities

  Guests must follow house rules set by hosts.

  Guests are responsible for any damage caused during their stay.
• •
  Guests must provide accurate information when making bookings.

5. Reservations and Payments

  Platform Payments: All payments must be made through the Staykay platform and Staykay admins reserve the right to review and validate submitted proof of payments.

  Booking: When you make a booking through Staykay, you agree to pay all charges associated with the booking, including applicable taxes and fees.
• •
  Payment Processing: Payments are processed through third-party payment processors. You agree to provide accurate payment information and authorize Staykay or its payment processors to charge the amount due.
• •
  Fees and Policies: Service fees and cancellation policies are clearly stated for each booking.
• •
  Host Payments: Hosts will receive payments according to the payment schedule outlined in their hosting agreement.
• •
  Cancellations and Refunds: Cancellation and refund policies vary by Host. Please review the specific terms of each booking carefully. Staykay is not responsible for cancellations or refunds beyond the terms provided by the Host.
• •
  Check-in Verification: Upon guest check-in, we will send verification to confirm the stay. If not disputed within 12 hours, the partial payment such as a down payment will be transferred to the hosts. The platform will not be liable for any refund thereafter.

6. User Verification

  ID for Verification: Guests must submit an ID for verification. This ID will be deleted 24 hours after check-out. Any other IDs requested by the Host for accommodation processes are not the responsibility of Staykay.

7. User Conduct

Prohibited Activities: Users agree not to:

  Use the Platform for any illegal or unauthorized purpose.

  Post false, misleading, or fraudulent information.
• •
  Infringe upon the rights of others, including intellectual property rights.
• •
  Interfere with the operation of the Platform or the enjoyment of the Platform by others.

8. Content and Intellectual Property

  User Content: Users retain ownership of the content they post on the Platform. However, by posting content, you grant Staykay a worldwide, non-exclusive, royalty-free license to use, copy, modify, and distribute your content in connection with the Platform.

  Host Content for Advertising: By listing your property on Staykay, you agree that Staykay may use your property listing, including photos, descriptions, and reviews, for advertising and promotional materials across various platforms and media channels to promote Staykay's services.
• •
  Staykay Content: All content provided by Staykay, including text, graphics, logos, and software, is the property of Staykay and protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any Staykay content without express written permission.

9. Platform Rules

Staykay reserves the right to:

  Suspend or terminate accounts for policy violations

10. Disclaimers and Limitations of Liability

  No Warranty: The Platform is provided on an "as is" and "as available" basis. Staykay makes no warranties, express or implied, regarding the Platform's operation or the information, content, or materials included.

  Limitation of Liability: To the fullest extent permitted by law, Staykay shall not be liable for any damages of any kind arising from the use of the Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Staykay, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform or violation of these Terms.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Philippines. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of Manila.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. We will notify you of any significant changes by posting the new terms on our website and updating the "Last Updated" date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
